1. Acceptance of Terms

By accessing or using DataCastle services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Use License

Permission is granted to use DataCastle's hosting services subject to the following conditions: You shall not use the services for any illegal purposes, distribute malicious software, engage in phishing, send unsolicited bulk email (spam), host content that infringes on intellectual property rights, or attempt to gain unauthorized access to any systems.

3. Service Level Agreement

DataCastle guarantees 99.9% network uptime for all services. In the event of downtime exceeding this threshold, customers are eligible for service credits as outlined in our SLA policy. Scheduled maintenance windows are excluded from uptime calculations and will be communicated at least 48 hours in advance.

4. Payment Terms

All services are billed in advance on a recurring basis (monthly, quarterly, semi-annually, or annually). Payments are due upon invoice generation. Failure to make payment within 3 days of the due date may result in service suspension. All prices are exclusive of applicable taxes unless stated otherwise.

5. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. DataCastle shall not be liable for any loss arising from unauthorized use of your account. You must notify us immediately of any breach of security or unauthorized use.

6. Service Modifications

DataCastle reserves the right to modify, suspend, or discontinue any part of the services at any time. We will provide reasonable notice of any material changes. Continued use of the services after such modifications constitutes acceptance of the updated terms.

7. Limitation of Liability

DataCastle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for the services during the twelve months preceding the claim.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms shall be resolved through binding arbitration, except where prohibited by law.
